The client represents to WebSiteDepot that any text, images, photos, graphics, logos or other documents or artwork supplied to WebSiteDepot for inclusion in or in creation of the website are owned by the Client, or that Client has permission to use these items. Client will hold harmless WebSiteDepot and it's subcontactors from any claim or suit arising from the use of such items.

WebSiteDepot will not disclose to any third party or use other than for the purposes of this Agreement any knowledge or information imparted to or obtained by it during or in connection with the fulfillment of this Agreement which is of a secret or confidential nature relating to the business, equipment, processes relating to the equipment, the products, services, process or business strategies offered or employed by the Customer.  This obligation of confidence will cease to apply in relation to information that WebSiteDepot is required to disclose by any law, or which becomes part of the public domain other than as the result of a breach by WebSiteDepot of its obligations of confidence under this Agreement.

Non-exclusiveAgreement

WebSiteDepot will strive to ensure that pages created by WebSiteDepot are free of errors. WebSiteDepot does not accept any liability for losses or damages arising from errors on any page of the created website. It is the clients responsibility to proof read their content prior to submission and again once the web page is created and notify WebSiteDepot within 30 days of going live of any required changes. Minor text changes during that time will be at no charge, after 30 days, regular charges will be assessed.

WebSiteDepot reserves the right to include a small text hyperlink to our site at the bottom of the client's site.

Cancellation and Refunds

If the client stops work after the initial payment has been submitted, we will refund the initial payment less the amount due for work performed up to that point. Rate for work to be calculated at $125/hour or our current hourly rate, whichever is higher. Cancellations must be made in writing, by e-mail or fax. If the project has been completed when cancellation notice is received, the client shall be responsible for the entire project cost.

WebSiteDepot provides hosting to our clients but reserves the right to refuse services to anyone for any reason. All payments for hosting services are due on a monthly basis. Failure to pay on time may result in suspension of services.

SPAM, Unsolicited Commercial Email

WebSiteDepot has a zero tolerance policy for spam. Our hosting clients may not use our service to send Spam. If spam activity is detected your account may be suspended. The client will not be credited for any suspension due to spam activity.
